Apple South Asia Pte. Ltd.

Repair Terms & Conditions

These Terms & Conditions (T&Cs) govern the service of your product by

Apple South Asia Pte. Ltd. (”Apple”). When your product is repaired pursuant to Apple’s warranty, extended service contract or any consumer law, these terms will apply, to the extent that they do not reduce your rights under Apple's warranty, extended service contract or applicable law. Please request a hardcopy if you prefer to review printed terms.

1.    Apple will service your product as described and for the charges shown on the previous screen, if any, including any goods and services tax. Apple may restrict service to one (1) product per customer during your visit to the Apple Retail Store. Before Apple provide repair service to your product, Apple may at its sole discretion to require you to provide valid proof of purchase. If you are unable to provide valid proof of purchase, Apple may reject to provide service to your product.

Apple understands that your data may be valuable to you. Data loss during service is always a possibility, and in some cases, data may be unrecoverable, erased or reformatted during service. For this reason, it is your sole responsibility to back up all existing data, software, and/or programs from your product, and to decide whether to erase any such data from your product, prior to receiving service. Apple is not responsible for loss, recovery or compromise of data, software or programs, or loss of use of your product or other equipment arising out of the services provided by Apple. You represent that your product does not contain any illegal files or data.

You acknowledge that your device may be sent out by common carrier to be serviced by an external service provider. For this reason, it's recommended that you back up your device and wipe it, prior to submission for service.

As part of service, Apple may install system software updates that will prevent your Apple product from reverting to an earlier version of the system software. Third party applications installed on your Apple product may not be compatible or work with your Apple product as a result of the system software update.

2.    If Apple inspects your product and determines that (i) service is required due to the failure of parts that are neither supplied by Apple nor Apple-branded, and/or (ii) service cannot be performed because the serial number has been altered, defaced or removed, or the product has failed due to accident, abuse, liquid spill or submersion, neglect, misuse (including faulty installation, repair or maintenance by anyone other than Apple or an Apple Authorised Service Provider) and/or unauthorised modification, Apple will return your product to you without servicing it and may charge you a diagnostic fee of S$129 (“Diagnostic Fee”). Apple will not be responsible for any damage to the product that occurs during the repair process that is a result of any unauthorised modifications or repairs or replacements not performed by Apple or an Apple Authorised Service Provider. If damage results, Apple will seek your authorisation for any additional costs for completing service even if the product is covered by warranty or an AppleCare service plan. If you decline authorisation, Apple may return your product unrepaired in the damaged condition without any responsibility.

3.    If service requires labour and/or parts not specified on the previous screen, Apple may seek your approval of a revised estimate. If you do not agree that Apple may revise the charges, Apple may return your product and hold you responsible for any indicated Diagnostic Fee.
4.    Apple may use parts or products that are new or equivalent to new in reliability and performance. Apple will retain the replaced part or product that is exchanged as its property, and the replacement part will become your property.

5.    Apple warrants (1) that the service will be performed with all reasonable skill and care and (2) that, for a period of ninety (90) days from the date of service, all parts used to service your product will be free from defects in materials and workmanship, unless otherwise specified by Apple. In the event of breach of the warranty in this section 5, Apple will either (i) re-perform the service, (ii) repair or replace the part, or (iii) refund the cost of the service provided. In order to claim under the warranty, you must return your product to the store where you left your product for service.

6.    If Apple is in breach of these T&Cs, it will only be responsible to you for any loss of damage that you suffer to the extent that such loss or damage was a foreseeable consequence to both you and Apple at the time you agreed to these T&Cs. Further, Apple and its affiliates, will not be liable to you for any loss of revenue; loss of actual or anticipated profits (including loss of profits on contracts); loss of the use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to, or corruption of data; or any costs of recovering, programming or restoring any program or data stored or used with your product; and any failure to maintain the confidentiality of data stored on your product. The foregoing limitations shall not apply to Apple's liability for: (a) death or personal injury, (b) fraud or fraudulent misrepresentation, or (c) any liability which by law cannot be excluded or limited. Apple specifically does not warrant that it will be able to (i) repair or replace your product without risk to or loss of programs or data, and (ii) maintain the confidentiality of data. Nothing in these T&Cs will reduce your statutory rights relating to faulty or misdescribed goods.

7.    If your product is returned to Apple because delivery could not be completed at the address given within sixty (60) days from the date of the first attempted delivery, or you have not claimed your product and paid all charges due (including but not limited to the Diagnostic Fee, if applicable) within sixty (60) days after first being notified by Apple that your product is ready for collection, Apple will consider your product abandoned by you and you give Apple the right to deal with your abandoned product as Apple sees fit in accordance with applicable law. Apple reserves its statutory and any other lawful liens for unpaid charges.
8.    If service involves transferring information or installing software, you represent that you have the legal right to copy the information and agree to the terms of the software license, and you authorise Apple to transfer the information and accept such terms on your behalf in performing the service.

9.    These T&Cs are governed by Singapore law.

10.    These T&Cs are the only ones that govern Apple’s service of your product.

11.    You agree and understand that it is necessary for Apple to collect, process and use your personal information in order to perform service under these T&Cs. Apple will protect your information in accordance with Apple Customer Privacy Policy available at URL http://mijiaqkg.cn/sg/privacy.

12.    The Goods and Services Tax ("GST") amount indicated is not final and may be subject to change. Apple South Asia Pte. Ltd. ("Apple") reserves the right to assess whether customer accounting is applicable and the final GST amount will be reflected on the tax invoice issued by Apple.
